The Energy Policy Act of 2005 (EPAct 179D), permanently extended by Consolidated Appropriations Act, 2021(CAA)

EPAct 179 allows the investor of energy efficient improvements to fully depreciate (100%) the entire cost of improvements in current tax year in which the improvements are made. After 12/31/2021 the amount of tax savings is adjusted for inflation.

The maximum deduction of $1.80/sq ft. is compromised of three partial deductions: up to $.60/sq ft. for lighting, HVAC, or building envelope each.

California’s Title 24 energy codes limit the amount of watts per square foot a dedicated space—such as an office building, restaurant, or parking garage—can use. Title 24 codes kick-in with any remodel or new construction requiring a permit. In addition to LED retrofits, Title 24 controls also dim and manage demand or turn off lights throughout the day.
